Department of Education posts names of persons disbarred or suspended

If you do something to get suspended or debarred by the Department of Education, you should also expect your name to be publicly reported.

In an October 25 Electronic Announcement, the Department announced the regular public reporting, on its own website, of a list of individuals who are currently suspended or debarred by the Department. According to the Department, Federal Student Aid (FSA) will regularly update the list, by adding and removing names, to reflect new debarments or suspensions and the expiration of such actions.

In the announcement, the Department said an individual or entity that is suspended or debarred by the Department generally may not be a participant in transactions with the Department or other Federal agencies while the suspension or debarment is in effect.

The Department also said, in addition to reporting suspensions and debarments on the FSA website, it will continue to report all suspension notices and debarment decisions to the Office of Acquisition and Grants Administration (OAGA). OAGA adds the individual or entity to its system and makes the information publicly available on the SAM.gov website for all schools and government agencies to search for excluded individuals or entities.

The Department said these steps are taken “in order to deter misconduct, ensure program accountability, and protect students and taxpayers” and “to enhance individual accountability in programs administered under Title IV of the Higher Education Act.”
