Institutions reminded to report foreign ownership and contracts

If you are marking important dates for 2024, you may want to note the deadline to file a disclosure report with the Secretary of Education.

In a December 12 Electronic Announcement, the Department of Education reminds institutions of a January 31, 2024, deadline for institutions of higher education to file a disclosure report about foreign ownership and foreign contracts.

According to the Department, institutions of higher education (IHEs) must file a disclosure report with the Secretary of Education “whenever the institution is owned or controlled by a foreign source or receives a gift from or enters into a contract with a foreign source, the value of which is $250,000 or more, considered alone or in combination with all other gifts from or contracts with that foreign source within a calendar year.”

The Department said failure to comply with the reporting requirement could result in an enforcement action.

Institutions can submit their reports online. The Department provides a Frequently Asked Questions to answer common questions about the requirement.
